The Legalities of Taking Photos For Your Website

I often get asked by clients whether they can post photos of work they’ve done on their website.

Beyond the common-sense advice of “it’s always better to ask permission,” it’s important to understand the legalities.

There’s a good article in USA Today that posts some guidelines:

  1. If you can see it from public property, you can shoot it
  2. Chances are pretty good that you can publish it

There are some important exceptions that these guidelines don’t apply to:

  • Government buildings or military bases
  • Taking a picture of a person who has a reasonable expectation of privacy

Obviously, this shoudn’t be construed as legal advice.
